Cadillac to Dial Back CTS Production as Brand-New ATS is Stealing Sales

2013 Cadillac ATS 137 Cadillac to Dial Back CTS Production as Brand New ATS is Stealing Sales
If you build the right product, customers will come. The thing is, some of them may come from places you don’t want them to. The Cadillac ATScompact sports saloon is still young but after its launch in September, sales of its slightly bigger sibling, the CTS, dipped a mighty 40 percent in October.According to data from Edmunds, that’s no coincidence. The ATS might be intended as a direct BMW 3-Series rival yet the CTS is also one of the most cross-shopped models amongst its potential buyers.
The good news for the brand, apart of course from the recent Motor Trend comparison test outcome, is that the Munich’s saloon is also on that list.
It’s not a rare phenomenon for two models of the same brand to encroach on each other’s space, but it’s still one that all manufacturers do their best to avoid. That’s because they don’t want buyers choosing between two of their products; they want to win over other manufacturers’ customers.
Cadillac U.S. sales chief Chase Hawkins told Automotive News that the company won’t be stockpiling CTS inventory and then be forced to apply huge discounts, as it had done in the past to its great loss.
“We’ve planned for ATS to take some CTS customers out of the market who we otherwise would have seen”, said Hawkins. “We definitely are going to be producing fewer CTSs next year to create some of that space for ATS.”
Cutting back on the older model’s production rate is a short-term measure. Cadillac hopes that the problem will be solved when the two cars put some more distance between them. This will happen towards the end of 2013, when the next-generation CTS, which will be larger and pricier than today’s car moving up to BMW 5-Series territory, will hit the dealerships.

The 2.0-liter unit gains 77 bhp in Mk3 and 83 bhp in the higher-revving Mk3.5 models, as well as 51 lb-ft (69 Nm) increase in both models, bringing output to 235 bhp and 241 bhp respectively.
MX-5 owners looking for more performance can opt for the Stage Two conversion, which in addition to the parts mentioned above, includes a new exhaust system, a performance air filter and a more aggressive tune for the ECU.
With the Stage 2 kit, output climbs by an impressive 107 bhp in the 1.8-liter engine, to 231 bhp and by 94 and 100 bhp in the 2.0-liter Mk3 and Mk3.5 versions, to 252 and 258 bhp respectively. Torque increases by 67 and 69 lb-ft (91 and 93 Nm) for the 1.8 and 2.0 engines.

A Flashback to BMW's Short Film Series "The Hire", Which One is Your Favorite?

In 2001, BMW launched a hugely successful campaign called "The Hire", which was a series of eight short films, each roughly eight to ten minutes long. The movies were directed by established filmmakers like Ang Lee and the late John Frankenheimer, with actor Clive Owen taking on the role of the "Driver" who was hired by a different person in each movie to transport important people in a number of BMW cars.
While over a decade old now, BMW's film series remains wonderfully entertaining to this day.
The crew over at Hooniverse picked the fourth movie from the first season titled "The Star" featuring the M5 E39, which was directed by Guy Ritchie and co-starring Madonna, as their favorite flick.
But since everyone has their own favorites, we've added all eight short films for your viewing pleasure after the break. Feel free to check them all out and tell us which one you prefer in the comments section below.

In Hennessey Performance's latest video, the founder of the company, John Hennessey, took some time off to show us the 2013 Camaro ZL1 with the HPE700 package that boosts the V8's grunt to 707bhp at 6,300 rpm on the crank in action.
There's also a second clip featuring the same manual gearbox model on the dyno, where it managed to spin the rollers at 678-horses and 601 lb-ft of peak torque at the rear wheels.

Automobile Law Lemon

It is a common question. You have purchased a brand new car, one that is supposed to work properly. If it doesn't work properly, why doesn't the manufacturer just take it back and give you another one? Why do you have to use the lemon law to fix this problem?
If life was that simple, there really would be no reason for the lemon law or the Federal Breach of Warranty Laws we work with. The lemon law is in place to enforce manufacturers to take responsibility for their actions, whether it be paint peeling, a knocking engine, a faulty transmission, a leaky sunroof or problems with the door locks. This is a David vs. Goliath situation. You are one person going up against a billion dollar organization. The lemon law provides a common ground where your voice will be heard and your situation will be reviewed. While most people do not want to go the litigious route, the law provides a very feasible solution to your automobile problems.
There are auto lemon laws in all 50 states and they cover all passenger vehicles, including cars, trucks and sports utility vehicles. Click here for a complete rundown of all Lemon Law statutes. There are also other sites which provide auto lemon law information, and they can be found on our Lemon Laws & Consumer Statutes page. Click here for a list of lemon law firms across the nation.
State Lemon Laws apply to new cars, leased or purchased in most states, which suffer a nonconformity. A nonconformity is defined as a defect or condition which substantially impairs the use, value or safety of the vehicle. The Law applies to an automobile which can't be fixed after a reasonable number of repair attempts. What is a reasonable number? It depends on the State's statute. In Pennsylvania and New Jersey, two states we handle, we use three warranty attempts as a guideline. In PA, the first repair must be made in the first 12 months or 12,000 miles. In NJ, the first repair must be made in the first 18,000 miles or 24 months. In DE, the first repair must be made in the first year, regardless of mileage. As you can see, each law is different. It is important that you review your Law carefully or contact a local lemon law lawyer to find out if your vehicle applies.
The Lemon Law also sometimes applies to vehicles which are in the shop for extended periods of time within the first year, regardless of whether it's one constant problem or a series of problems. The Pennsylvania Lemon Law for example, covers cars in the shop 30 days in the first year. The New Jersey Lemon Law applies to cars in the shop 20 days in the first year.
Remedies under the auto lemon law are based upon the severity of the situation. You could be looking at a new car, or full buyback, or perhaps a partial refund or extended warranty and continued ownership of the car. In most cases, the legal representation under the Lemon Law is cost-free. In the states we handle, Pennsylvania, New Jersey, Delaware, Massachusetts, Ohio, and New Hampshire the laws have fee shifting provisions where if the plaintiff prevails, the manufacturer must also pay all attorney fees and legal costs. If we accept your case, and for some reason you do not prevail, there is no charge. We are very pleased to offer 100% cost-free lemon law representation and there are other firms across the nation who provide this as well.
It is also important to note that even if your automobile falls outside the State Lemon Law, there is a chance that you could still seek remedy under Federal Warranty Statutes. Also, there are Unfair Trade Practice Laws, which protect consumers against automobile dealer fraud, odometer rollback, and used cars with lemon or salvage titles. It does not hurt to ask about your rights. Feel free to e-mail us with any questions and we will direct you to the right source.

Auto Accidents

Car Accidents
Car accidents are a leading cause of unnecessary deaths and therefore the number one source of personal injury claims in the United States. In 2005, 6,087,000 cars were involved in accidents, according to a recent crash data report by the National Highway Traffic Safety Administration (NHTSA). This comprised 56.1 percent of all motor vehicle crashes. In that same year, fatal automobile accidents took the lives of 18,440 people, and injury accidents harmed another 1,573,000.

Many of the accidents occurred due to negligence on the part of one of the drivers involved. When a car accident is caused by another party's negligence, people who are harmed often reach settlements with the liable party which provide compensation for medical expenses, pain and suffering as well as other damages.
In this article you will find information on the legal issues associated with car accidents. To obtain further information, you should contact a car accident attorney who can help evaluate your specific situation and determine your legal rights.
Car Accidents and the Law

As a legal matter, a car accident occurs when a passenger car (convertible, sedan or station wagon) is involved in an event or series of events that causes harm, such as property damage, traumatic brain injury and/or death. In 2005, 82 percent of car crashes involved a collision with another motor vehicle and the other 18 percent involved collisions with stationary objects and other non-motorized objects, according to the NHTSA. Most of these motor vehicle accidents involved an element of negligence, corresponding with a traffic law violation. If you have been arrested for driving under the influence in conjunction with a motor vehicle accident, you will want to speak with a qualified defense lawyer — regardless of whether it's a DUI first offense or repeat offense.
Negligence

To be compensated by either an insurance company or a court award, negligence usually must be proven. Negligence is a legal term that means someone has failed to act in a reasonably careful and responsible manner. In the case of a car crash, negligence is found in facts derived from the police report, eyewitness testimony, expert witness testimony, photographs and sketches of the crash scene. Proving negligence means showing that:
Someone's carelessness caused the car accident
The car accident caused harm and
The party at fault is responsible for paying compensation for the harm done
If more than one party involved in the accident is at fault, liability may be distributed among the negligent parties according to percentage of fault. This is called comparative negligence.
Compensation for Car Accidents

Receiving compensation usually means having your property repairs, medical expenses, lost income, physical and psychological pain and, if applicable, lost prospects paid for by the negligent party or parties. Insurance adjustors and juries typically use standard formulas to come up with a dollar value for car accident settlements.
No-fault insurance laws affect settlements in some states. In general, these laws prevent injury claims and lawsuits from being filed in trivial accidents. While they usually guarantee immediate insurance payment for medical expenses and lost wages, many other expenses are not covered. If you have been the victim of a car accident in a no-fault insurance state and have not been fully compensated for your losses, alawyer can help determine if you are eligible for additional compensation.
Factors Contributing to Car Accidents

A number of factors contribute to car accidents, and many are the result of some form of negligence. Some of the most common are:
Driving While Distracted. Distracted drivers account for approximately 80 percent of auto accidents and 65 percent of near accidents, according to the National Highway Traffic Safety Administration (NHTSA). Each year, motorists cause thousands of driving accidents while texting, making cell phone calls, putting on makeup and performing other tasks. Many states have outlawed texting while driving, and/or driving while talking on handheld devices.
Traffic Law Violations. Most car accidents can be traced to negligence in the form of one or more traffic violations. Common violations include speeding, tailgating, improper lane changing, and failing to yield the right of way. When a traffic citation is issued at the scene of a car accident, any claims are strengthened.
Driver Error. Driver error is the cause of most traffic violations leading to car accidents. Factors contributing to driver error include fatigue, drowsiness, distractions (cell phone use, eating, etc.), inattention, intoxication (drugs, alcohol, medications) and aggressive driving. A study conducted by Virginia Tech University in 2006 showed 80 percent of motor vehicle crashes involved distraction, fatigue or looking away from the road. The same study showed that 93 percent of rear-end collisions occurred as a consequence of inattention. Note that harm caused by driving under the influence is not just a criminal violation — it can also be grounds for a civil suit.
Equipment Failure. Mechanical failures leading to car accidents often involve brakes, tires, steering mechanisms or suspension. A malfunction might point to negligence on the part of the owner or operator of the car, a mechanic or auto repair shop or the manufacturer for designing flawed equipment (e.g., seatbelts, airbags or roofs). Some of the best known cases of equipment failure involve manufacturer design flaws and often result in class action lawsuits involving large settlements. If you suspect equipment failure or a manufacturing defect contributed to an accident you were involved in, be sure to retain possession of your car so that it can be used as evidence in a trial, if necessary.
Road Conditions. Road conditions can be affected by weather, road construction, debris on the roadway and other factors. When road conditions contribute to car accidents, negligence is often involved. Sometimes the government is the negligent party. For example, if a dangerous pothole has gone without repair for an extended length of time, the government may be liable. There are specific rules and time limits for filing a car accident claim with a government entity. For more information, you will need to contact a car accident attorney.
Road Design.F lawed road design can involve intersections, merging lanes, traffic control devices and other factors. When the design of the road is a contributing factor in a car accident, the government may be liable.
When You Might Need a Personal Injury Attorney

Insurance companies frequently handle routine car accident claims, the majority of which involve property damage only. However, accidents involving serious forms of injury, such as closed head injury, often require assistance that only a personal injury attorney can provide. In these situations, an injury lawyer can help determine your rights and facilitate any claims you may have to compensation greater than the initial settlement. They include the following:
The insurance company won't pay the full cost of property damage, medical expenses, lost income, psychological pain and lost prospects. Many of these types of claims are made against insurance companies in no-fault states.
The insurance company delays settling a claim. Each state has a statute of limitations for filing personal injury claims, so beware of allowing insurance claims to drag on too long.
The insurance company denies a claim (Sometimes the insurance company of the other party involved in the accident will claim their insured was not at fault or that the insured's policy did not cover the accident.)
The party at fault does not have insurance.
You also should consider hiring a personal injury attorney when a government entity denies a claim, allowing a personal injury lawsuit to be filed.

Honda Issues a Single Number Recall on 2012MY Odyssey Minivan

2012 Honda Odyssey 2 Honda Issues a Single Number Recall on 2012MY Odyssey Minivan
If you happen to follow the automaker recall notes, you may notice that quite often they involve a specific batch of models, be that for a parts defect or an error during the assembly of a car.
In Honda’s case, the safety recall involves only nine Odyssey minivans from the 2012 model year, built from October 31, 2011, through November 30, 2011.
The reason why the Japanese automaker issued this recall is that the retention nut for the front right lowersuspension damper bolt may not have been tightened to the proper torque, which could allow the nut to loosen.
Honda says that if that were to occur, the front hub assembly would only be attached by one bolt, allowing thewheel assembly to shift to an extreme inward angle resulting in a loss of steering – and that’s something you don’t want to happen on the road…
The Japanese company says it contacted all nine owners by phone on December 19. Nevertheless, if you own one of the affected models and have more questions, you can contact the company directly at 1-800-999-1009.
